Credit card processing in New Jersey

New Jersey allows credit card surcharges but writes its own limits into law: no more than your actual cost, and detailed disclosure before the customer is charged, including on restaurant menus. Dense suburbs, a major port and a summer shore economy make the rules matter.

New Jersey law (N.J.S.A. 56:8-156.1) caps a credit card surcharge at your actual processing cost and requires the amount to be disclosed before the customer incurs a charge. The New Jersey Division of Taxation lists the sales tax rate as 6.625%.

From liquor stores to diners and restaurants: New Jersey's business mix

Newark and Jersey City sit next to Manhattan, with commuters, logistics around the port and airport, and a diverse small-business economy of restaurants, markets and services. Suburban corridors hold malls, diners and professional offices.

The Jersey Shore, from Asbury Park to Cape May, runs on summer visitors, and Atlantic City adds casinos and conventions. Princeton and New Brunswick bring universities and pharmaceutical firms.

Surcharging in New Jersey: what applies

N.J.S.A. 56:8-156.1 and 156.2 allow a credit card surcharge that does not exceed your actual cost to process the payment. You must disclose the amount before the customer incurs the charge: signs at the entrance and point of sale (for restaurants, the service area and the menu), on the online checkout page, and verbally by phone. The Division of Consumer Affairs publishes an FAQ.

Which pricing suits diners and restaurants?

New Jersey's cost cap means you need to know your real cost per card type, which is hard on flat-rate pricing and easy on interchange-plus. Restaurants that surcharge must update menus as well as signs. Shore businesses need pricing without off-season minimums, and wholesalers near the port should use commercial card data and ACH.
